EST2302P. Planning for Beneficiaries with Addiction and Mental Illness Issues
Estate planners and allied professionals need to be aware of the prevalence and myriad manifestations of addiction to be able to address the issues it creates in a family’s estate planning documents. A well-drafted trust can go a long way toward helping a family and an addicted beneficiary through the stages of recovery, relapse, or the choice not to seek treatment. The estate planning team of professionals cannot solve the problem, but can help a client assemble a team of professionals to assist the family and the beneficiary, guided in part by a trust agreement.
